Terms of Service

1. General provisions
1.1. The Mapelo service available at mapelo.app and the Mapelo application are operated by akApp Studio (unregistered business activity under Polish law, Art. 5 of the Entrepreneurs' Law Act).

1.3. By using the service and application, you accept these terms.
2. Definitions
- App — the Mapelo web application (PWA) for managing customers on a map.
- User — any person using the App or mapelo.app website.
- Data — information entered by the User into the App (customer data, notes, photos).
3. Scope of service
3.1. Mapelo allows the User to manage a customer database, display customers on a map, log visits, navigate, and plan routes.
3.2. The App operates on a local-first model — all User Data is stored exclusively in the browser's local storage (localStorage) on the User's device.
3.3. The Operator does not have access to any Data entered by the User into the App.
4. Test version
4.1. The App is currently in a testing phase (early access). Features may change without notice.
4.2. Data stored in localStorage may be lost due to clearing browser data, system updates, or changing devices. The User uses the test version at their own risk.
4.3. The Operator makes reasonable efforts to ensure the App works correctly but does not guarantee availability, error-free operation, or uninterrupted service during the testing phase.
5. User responsibility
5.1. The User is solely responsible for the data they enter into the App.
5.2. The User agrees not to use the App in a way that violates the law or the rights of third parties.
5.3. If the User enters personal data of their customers, they are the data controller under the GDPR and bear responsibility for processing that data in compliance with applicable regulations.
6. Intellectual property
6.1. The name "Mapelo," logo, source code, and visual design of the application are the property of akApp Studio.
6.2. The User is granted a non-exclusive, non-transferable license to use the App for its intended purpose.
7. Early adopters list
7.1. On mapelo.app, the User may voluntarily sign up for the early adopters list by providing an email address.
7.2. The email address is used solely to notify the User about the App launch and potential promotions.
7.3. The User may unsubscribe at any time by emailing contact.mapelo@gmail.com.
8. Early adopters program
8.1. The Operator offers three tiers of benefits for early users: a promotional launch price, a better deal in exchange for feedback, and lifetime access for exceptionally valuable contributions.
8.2. Evaluation of contributions and granting of benefits is at the sole discretion of the Operator.
8.3. "Lifetime" means: for the entire period the Mapelo App is operational. If the App is permanently discontinued, the obligation to provide the service expires.
9. Limitation of liability
9.1. The Operator is not liable for the loss of Data stored in the User's localStorage.
9.2. The Operator is not liable for damages resulting from the use of the App in its testing phase.
9.3. The Operator's maximum liability to the User is limited to the amount paid by the User in the preceding 12 months (or PLN 0 for the free version).
10. Changes to these terms
10.1. The Operator reserves the right to modify these terms. Changes will be announced on mapelo.app.
10.2. Continued use of the App after a change constitutes acceptance of the updated terms.
11. Governing law
11.1. These terms are governed by Polish law.
11.2. Any disputes shall be resolved by the courts having jurisdiction over the Operator's registered location.
